Gilles Rearsets fitting ?

I have just bought some Gilles rearsets for my 749R and when fitting them I found that the right side carbon heelguard hits the Exhaust heat shield and is VERY tight up against it.
When looking at a couple of pictures that I found on websites they look as though the heelguard is curved the same as the other side which would fit fine whereas the one that is in my kit is virtually flat which would be fine if the full system was fitted as the pipe work is a little further back but on the assymetric system which most people with 749/999s have it hits.
Anyone else got these rearsets, did they have the same problem, how did they get around it or could the heelplate be wrong ???
Thanks

I fitted some to my 996 last month and had to use the two 1cm spacers provided to miss the exhaust guard. Makes the rear brake pedal slightly out of line but I never use it much anyway ....

use thread lock on the fasteners. All of them. They come undone all on their own
