Did you tick the box to remove you from the edited register of the electoral role?

Then try this site

http://www.b4u.co.uk/

Go to the bottom of the page and enter your details in find a friend.

Are you on there? If you go to the contacts link there is an email address to request removal. The cheeky b@stards have made their phone contact number a premium rate number.

Next port of call is the local electoral registration office and a possible breach of ECHR.:flame:

Looks like Wigan Metro are doing their job as I am not on it, but an old girlfriend who owes me some money is!

Having said that I have also registered with the Mail Preference Service, takes about 3 months to kick in but then it becomes an offence to send junk mail to your address.

http://www.gov.im/dlge/waste/tips/home/junkmail.xml

There is one for unwanted calls also.

This argument fails in my estimation in that the intial entry of your data on the register does not contravene the Three Tests namely;

. It is prescribed by Law
. It is intended to acheive a legitimate objective and
. It is proportionate.

Further in pursuit of Section 6 of the Act, the local authority could not have acted differently ( by refusing to release your information ) due to primary legislation requring them to do so ( either the full or edited registers depending on the applicant and the intended purpose the information was to be used for ) on payment of the necessary fee.

Had you decided to remove yourself from the edited register by annoting your electoral registration form to that effect then you may have a means by which a complaint may succeed.

If however you did not so removee your details from the edited register, then the only chance of a complaint being upheld would be for you to prove that the local authority, and not a private company or individual, passed on the details held in the full register for purposes not permitted under the legislation.

For more information, start here..... Representation of the People Act 2000 (http://www.opsi.gov.uk/acts/acts2000/00002--a.htm#9)

but Andy, Chris did start his post with "Did you tick the box to remove you from the edited register of the electoral role?" so I suspect he did - as did I and Michael did too, yet we're on there. Not impressed with that, though admittedly useful to know where other people live!

I'm aware of that as I did too, hence the next to last paragraph, you have to show that it was the Local Authority who released the data from the electoral roll and not a third party, not being an authority under the Act, who has supplied the information to the company for a complaint under Article 8 to succeed.
This is not the only site where you are captured and your details are available for public consumption, 192.com is another just as an example.

I didnt think this would have applied to me living in Scotland, how wrong was I.
The worrying thing is that I'm in it both where I live now and my previous address in Nottingham that I sold over four years ago!:puzzled:

I suspect that the data has been taken from year before last's electoral role, at which time we weren't given an option of opting for an edit register. The data which has aleady been sold is out there and it will take years to catch up.
I will be emailing to demand my removal.

Rather scary.

I'm on there and I have taken all the precautions I thought I needed to to hide my whereabouts
( But so is one of the blokes who was after me ) I wondered where he lived now. :D

More scary though is that two of my mates who are serving police officers are also on there - Not a good idea. E-mail on its way to them a.s.a.p.

Been onto the local electoral role people and I am not listed on the edited register and have not been since the old poll tax days. So the source of the info is not from them. So where is it from? Sent an email to B4U on 16/10 and have still not been removed or had a reply. So, how best to proceed now?

The problem is that so many companies sell their address lists to marketing companies and websites such as this.
If you've bought anything by mail order, then the company you used is a potential source of your details.
Similarly magazine subscriptions, even donating money to charity.
The solution is to do what you have done, and repeat the email on a weekly basis for a while using the unsubscribe link at the bottom of the page.
I know when I did the TPS application it took 28 days for my number to be logged into their system and the block to become effective.

Rushjob makes some valid points. I am very careful in ensuring that I check the necessary 'do not disclose to third parties' box on all application forms etc.

Will keep resending the email as you suggest.
