If the paperwork is wrong get a lawyer-they have to have the paperwork correct-if your mates plead not guilty and go to court themselves they will get turned over, if they take a brief they stand a much better chance.
ACPO guidelines are just that, guidelines, they don't HAVE to stick to them but usually do to save hassle.
