Quite straightforward to fill in the forms, as Dickie said, but you do have to give sufficient reason for the divorce to be granted. It's pretty much a rubber stamp job if they're properly filled in but you don't want to risk not getting the divorce for lack of grounds. If you want to get the forms from the court then give me a buzz for a bit of guidance on what to put on them, PM me for my phone number and I'll go through it with you. |
It really depends on the reasons and the timeframe. UK Law allows a 24 month time period for divorce but in Oz its 12 months. This is dependant on what the reason for divorce is. I'll let you know when I've finished :D Sorry, edited to reflect accurate timeframes! |
Albi If there are no children in the marriage you can do it all yourself without a solicitor, but should there be any discrepencies in equity etc being split evenly then you would be well advised to get a solicitor, it comes down to "Needs of the Parties". You can instigate the divorce proceedings by going to your local court and getting the papers, If memory serves it will cost about £150. Give us a shout if you want any advice, went through this a few yeras ago and I learnt a lot about the divorce proceedure. Good luck mate but one word of advice, the courts don`t like you divying up the equity and assets before the divorce and keep the seperation & divorce as friendly as possible, it makes life a lot easier. Do`h thats two things. |
Thanks Guys. I have downloaded the forms. Cost me 40 quid. It costs £330 in court costs which she said we would split. Annoying thing is I have to instigate everything even though she left me and were both happy and moved on. But all the forms are biased against me in literal sense regarding the children and maintainance. I know it will be ok but the wording is set up like its always the bloke who left her to cope with kids and shes divorcing me. Wish she would and paperwork would be a doddle. |

I managed to buy her out of the house, kept my pension and was awarded prime carer status by the court for my sons, and she has to pay me 50p per child per year maintanance. Quite a good result methinks. And I kept the bikes as well. |
