License and points question Can anyone tell me what happens when you reach 12 points on your license? I know there is some sort of ban, but how does it work and for how long? Assuming that you worked your way up to 12 points, but that 3 were due to go off your license in a few months what is the situation? thanks folks :( |

you get a ban for toting up. depending on what the last offence was may have some bearing on how long the ban may be, then there are also mitigating circumstances. With regard to what's already on there if they are spent before you go to court then they will not count towards toting up |
ok, next question.... if its a mobile speed camera (out the back of a van) if its on the other side of the road facing towards you, I assume they can still catch you? I know that i have been done by a van on the other side of the road before, but that was me driving away from it not towards it. |

They may not ban you if you give them a good case as to why you need to keep your transport, I know people with 15 points and still going (but slowly). I would bet you will get off with this one, they normally stop you further down the road with a mobile speed camera. You could always get an alibi and say that it must have been someone with a false number plate, your honour as I was in Afganistan at the time. [Edited on 19-11-2004 by Desmo748] |
I think you'd be ok Lily, my mate had 4 points somehow, got busted for 96 in a 60 limit and they gave him 8 points to max him out on 12 for 3 years. He kept his licence cos he explained he needed it for his business otherwise it would've been no points and a 3 month ban which is what my other mate got ! Best plan is you're selling your car and weren't driving at the time ! ;) |
You will need a good solicitor to represent you and providing you can show genuine hardship you should be ok. One thing to remember though is that this is a one off application & if you get more points whilst your licence is maxed out it's an automatic ban with no faciity to present the undue hardship argument again. OHH NO The 12 point accumulator usually means a 6 month disqual i believe :mad: dont panic yet and DONT whatever you do, respond to any NIP (notice of Intended Prosecution) until youve really looked into the options, do a bit of research, it will cost you time but can really pay off, see u2u |

i though that you can only get caught going away from a camera and its illegal for them to flash you coming towards the camera, thats why the vans are always parked with the back door facing the way your going, mind you if you were on your bike and it was facing you it wont matter as you have no plates 3 of my mates on their bikes went through a camera van facing them doing over 140 and didnt hear a thing as theres no front plates hope this helps ya |

i got 3 points from a camara van, when on me bike. the camera was pointing towards me so i wernt to worried.but a few days later an nip arrived. so either theres a nother cammera pointing out the front or they can turn the camera around? |

You accepted the penalty which is in effect a guilty plea. You can only appeal against it if you pleaded not guilty & a Court then went on to find the case proven against you. You could have appealed to the Ticket Office prior to accepting / paying it ( even so I wouldn't have held my breath.... ) Andy |

So a reg number written on paper is not enough, it would not stand up in court especially if you can prove you were 100 miles away at the time. If they do not have a picture then tell them to sing. I was always under the impression ( but probably incorrectly ) that you were okay on 12 points BUT it is the 13th point that gets you the ban, so going on my thinking, if you keep your nose clean until one lot of points comes off and don't get any more, you should be okay !! I hope for your sakes that that this is the case... Fingers crossed ! Helen x |

It is up to your defence to prove a mistake is made, a photo would just add to the evidence. " Yes it will, been there, done that & won numerous times. You would need to prove where you were & beware of using dodgy alibis, they can be and are, checked. Even got a bloke sent down for Dangerous Driving when he knocked a lad off his moped & drove off but his number was written down on a bit of paper by a bloke following the moped. The punishment for making up a false story & getting caught leaves you with a criminal conviction which can have adverse implications in many professions. The Thelwall Viaduct uses fixed unmanned cameras - no one there to look at your plate as you go past. This was a van with operators in it whose heads are capable of turning & taking a look.
