You city money boys and mortgage money
 
Any body come up with any money,bank phrases i can use .....

Thje circumstances are
I have just changed Mortgage, and am now with a different lender.

The whole deal was complete on the 2nd Jan, settlement figure done in full.

On the 3rd jan the old mortgage company drew another amount of money from the direct debit!

They tell you not to cancel, i would of done regardless but crimbo got in the way a bit.......

In my opinion this money on the 3rd is totally outside of any settlement figure as that has been done and dusted.

So i rang, spoke to the call cantre numptie, they told me they could see this money sitting in my old now settled account as a positive amount..............but ill have to wait to get it back!

Spoke to the smarmervisor who said i would have to wait 10 days to get it back!

Youve guessed it, 10 days on still no money back!

I would call this dishonestly apropriating property belonging to another.......let alone the interest!

in this instance you are protected by the Direct debit Guarantee, just call your bank, explain it and they will get your money back .. usually quicker than dealing with the people that took it to start with

i'd call it a valuable lesson learnt in remebering to cancel your direct debit.

you'll get it back obviously but its still a pain i agree.

Use their own terms back on them. Send them a bill indicating interest will be calculated daily on the outstanding amount.

That you gave them 10 days to sort it out was a goodwill gesture on your part as you would be entitled to the money back straight away.

If no immediate resolution, get the financial ombudsman involved. http://www.financial-ombudsman.org.uk/

Thanks guys...well ive tried my own bank with regard to the debit Guarantee.that was a mission in itself getting a phone number..........HSBC! then after all that, ive got to wait for the specialist dept in hsbc to come back to me!

Im now awaiting the Supervisor to get back to me.......again!

Dealing with these big companies is about trust in their professional ability, surely.................yeah right!

yeah it would be if any of them knew what the fcuk they were doing!

it always amazes me how little the vast majority of mortgage 'advisors' actually know. i have made them aware of deals or better terms i can get from thier own companies on more than one occasion.

it annoys me because there are plenty of people who are paying too much for their mortgages because they have been given poor advice.

they really are pants :mad:

Well obviously i had to call her again as it seemed as though i was waiting forever..........I got hold of her!

I cant believe i was getting the weve got to see the money clear" story again, when it was sitting on my account with them 13 days ago!

I have to say i have had my nice face on throughout this...........until now!

Chicken your a star.........i spoke about daily interest and then COMPLAINT! i was put on hold...............then funnily enough the cheque is in the post!

Ive threatened to haunt her if i dont get it by the end of the week!

;)

I find this far more infuriating than any speed camera........

:D But was it with the intention of permanetly depriving you of it?? ;) sounds like section 1 of the theft act, 1968 to me.

Then bill them for time wasted etc.

Calculate it at your normal daily / hourly rate (not an exagerated rate as some try)
Add any phone calls etc

Then send it as an invoice with 28 days to pay.

When they don't pay, send a red notice advising that you'll take legal action.

When they don't pay, file at small claims.

It does work ;)
