Speeding Ticket Just received a N.I.P from the police informing me I had beed done for 46 in a 30 zone. I travel down that road every day and I know there is no speed camera there and it was also at 07:16 in the morning. Does anyone have copy`s of the MCN articles about not disclosing personal details of the driver etc as in contravenes (I know its not spelt correct!) your rights to remain silent so as not to incriminate yourself. I also beleive that if they do not give you their evidence withing the last 7 days on the 28 day required for you to submit your details, then the case is not admisible in court! There was also a letter printed in MCD about admitting the offence and pleading guilty under threat, this also being inadmisable in court. Some help would be appreciated chaps as they have told me they have photographic evidence but I do not have their evidence! |
|
My understanding is that they have to serve notice on you within 14 days of the offence or it is time barred. With regard to disclosing details of the driver, there is a test case going through the European Courts at this time, but will almost certainly not be resolved until after your case. If you are likely to get done under the totting up system then you are advised to see a Solicitor who specialises in these types of offences. |
The 14 days is for them to issue and post the NIP, it can take as long as it takes to get to the driver - hire vehicles/fleet cars etc. can come through much later and still be valid provided the NIP is issued within the 14 days. |
not worth the hassle . . . they will get you one way or another - payup - take the points and stop speeding!!! However 46 is a very good number!!! Khushy |
Where was the offence commited . Was it somewhere local to ourselfs. Ditto Pepipoo. I got some good advice off them some time ago. |
Not having a good week are you !!!!! |
Quote:
It would have been someone hiding in a van that got you,....the same as when I got done coming back from the GP. I was pretty peed off about it too,and looked into the 'legal loopholes'.At the end of the day it was far easier to grin and bear it and pay the fine.£60 and 3 points. |
not a good week then rob, it could be worse though........chin up .. |
So..........was it you? |
I tried taking advise from pepipoo a couple of years ago, didnt disclose driver details etc due to the "test case", ended up with 4 points and £350 fine, my advice is dont try to be clever, fill it in and return it if it was you |
Acpo Quote:
BIG BROTHER IS BAD ENOUGH ON TV ! Why do we have to have it on the roads as well ?! I got off mine because the officer who zapped me had a mobile phone on her which was switched on ! Read the ACPO @ (it's there to offer you a degree of protection against 'mistakes' made buy the user) http://www.acpo.police.uk/asp/polici...2 0.pdf%20%22 find out what kit you were "detected" by & use the info it gives you accordingly if you want a copy of my letter(s) that I sent, let me know good luck G |
Sharpy Any letters etc would be greatly appreciated. Will update you when I can get some info from them about the detection equipment! |
better pm me your email addy |
from that code of practice linky thing, I've always been amused by this statement: Never point a speedmeter at a civil or military aircraft, vessel or armoured vehicle. Many military aircraft, vehicles or vessels have target acquisition detectors, some of which initiate automatic counter measures. |

now there's an interesting game of Police Russian Roulette just waiting to happen ! LOL |

Oh...if only  |
I had this at work earlier in the year, slightly different circumstances since the offence was in a company owned vehicle. Genuine "could not identify the driver", possible one of four culprits. Received the NIP, wrote back advising of the problem providing full details. About one month later received a rather officious letter threatening all sorts of punishment which I really did'nt like the tone of and binned. 2 months later the company received a summons, I went to Court this June and we were fined £300 for not disclosing the driver and no points were received on any licences. Prior to attending court I did gen up on the pepipoo site tho' |
Could always keep to the limits.......................:D How difficult is that? |
When you see just how many people are getting done --king not Difficult by the looks of things. If only the prat,s behind the camera's were a little more tolerant and aimed it at the real speedster's and vehicles that should'nt be even on the road. How many times do you see complete prats on the road and never a copper or "camera " anywhere in sight to do dam all about it. Drive along an open road with no one else on it and no danger to anyone else and some nobhead moneymaking ****bag does the dirty all in the name of "Safety" Bit like Police cars travelling along the Motorways at 70 ther'e the only vehicle doing that speed, every other normal person is getting on with their journey then having to slow down in a panic as every one brakes causing mayhem behind for the next two miles "Safety" my arse. When you ride or drive "progressively" you are more alert, more safe,no wonder you see signs on the motorway "Take a break tiredness kills" at some of our speed limits no wonder people fall asleep, bloody boredom. Rant over, Ill go and lie down now, have a Power nap, take a pill  4D (Cant wait to see the reply's ) |

There's a mini love-in going on elsewhere on another post so not much venom floating around, give it a while and the boys will be back. I have to say I aggree with your comments, but I never go over the speed limit myself I think it's outrageous thing to do. I amazed the MT has not clamped down on speeding they do elsewhere. Should I get my coat now and hand in my resignation on the way out? |

So thats it then, all those that exceed the speed limit and are prats take one step forward..............................Its allright Occifer, dont do me, im driving progressively! What a load of........... Its post like this that make me laugh, we all know what the rules are.......whether we agree with them or not, they are the rules.........and more to the point, this rule about speed has been done to the death, so everyone knows about it..........sheet, they even put up big signs! If your all driving /riding so progressively, being more alert, more safe, how come you dont see the cocking speed limit signs! They dont just spring up, they are concreted into the ground! The truth is you got caught speeding.! The arguement isnt, it wasnt me!...its how do i get off of this? And, if its more than once.......which bit is not easily understandable? As far as the sequence of brake lights coming on on motorways goes, is just about like everything else that is wrong with driving today, its down to lack of observation, and planning! Now to balance this somewhat, i do agree the limits are somewhat draconian and out of date with the modern world. I would even agree that the placement of cameras and mobile cameras can be to say the least poetic with the stats. I know catching speeding motorists is like shelling Peas, if your into that, which i personally am not. In fact, most of my replies to subjects like this are either devils advocate or tongue in cheek. But, if you disagree with the system stand up and say it to the right people...........not just when youve been caught, because theres only one person to blame when youve been caught its YOU! PS, this is just a response to the topic rather than anything directed at anyone. |
Andy, I'm getting a slight sensation of, you maybe an upstanding citizen in a blue suit, sorry I don't know how that happened. :) :) |

Andy, maybe if we all became Police Officers we could all brake the law legally, have big accidents ,run people down (as was on the TV news) get our kicks speeding and honing progressivly around the countryside on her Majesty's pleasure.Ive seen plenty of pursuit vehicles "training" on some of the local roads, its only a human being behind the wheel, some get it right some don't,to the child thats crossing the road in front of them ,it makes no differance, a fast vehicle is a fast vehicle .So I think your anwser's are a little bias and expected from a PC Us mortals have to do it the hard way, Im not saying we HAVE to break the law to enjoy our riding, far from it but some times it not that easy to leave the bike in 1st gear to keep to 30 with so much power to hold back and with so much forward planning and observations that we as motor cyclists have to do to survive, looking down at speedo's shouldnt be our main observation, especially with so many "prats" on the road. Regards from not such a progressive rider from now on. 4D |
They say that riding a Police pan with all the switches, bells and whistles to play with on a blue light run, is akin to flying a helicopter............. Oh well im allways in the clouds anyway! |
Andy, Got any vacancies (please) 4D |

Dont switch yer mobile on though, those poor sods going past at 20mph will be so unjustly dealt with and persecuted for exceeding the speed limit by a zillion mph over the top.........its the states fault! |

OOh, seen the news today about this.......perhaps i should write policy?  |

Yes, it did seem somewhat ironic that the ACPO wants to close the "loop holes" but that they wouldn't exist if the Police did everything correctly in the first place! More here: http://news.bbc.co.uk/1/hi/uk/5340846.stm (edit: oh, and that wasn't directed at Andy btw, or any of our other serving hoccifers, but as has been mentioned, both sides must play by the rules ;) ) |

We posted the same thing at the same time, looks like were bored with our work today. ;) |
Work?.............Im in a loop hole at the moment! The problem is the rules are there for all to see............watch some smart arse point to prove lawyer come along...........:borg: |
