Families who needs them????? Right Guys and Gals i am in a bit of a dilema and need some advice. I took the new 749 round to the wifes Uncles to let him see it. I went inside for a drink of water as it was scorching hot, as i walked in his front door i heard that distinctive plastic meets tarmac sound. The **** had only gone and sat on the bike and dropped it:mad: I lost the plot and had to walk away before i snapped him in 2. His attitude was unbelievable ranging from....."It's only a bike" to "I hope it is insured"........... Rab at Ducati Glasgow opened up specially on Monday to put it in for repair as i was going back to the rigs. The damage is £500+ rear brake lever snapped, front brake lever damage, clutch cover, RHS fairing etc etc. The idiot is now decided he is not paying for the damage. What can i do? 1. Cause £500+ damage to his BMW sat in his drive way, and see how he likes it! (Looking favourite) 2. Turn him upside down and shake him until my money falls out Any other suggestions? The bike was only TPFT so not insured for space cadets getting on it and dropping it!!!! I am gobsmacked at his attitude, if that had been me with someone elses pride and joy i would have been groveling and beside myself with apologies and embarassment. With Mastercard at the ready to pay for the damage. Scottch and i spoke about it at length, what makes it worse is he is a fellow biker. What is it with people and bikes, just because it has a seat does not mean you have the right to sit on it!!!!!! I swear if he was not related to the wife i would slap him. What are my options? :( |
He is a fellow biker so should therefore know better. If her refuses to pay involve the police. He is completely taking the p*ss because of the loose family connection. If you have no joy through the police route then I would have no moral dilemma's taking other courses of action that you have mentioned. As he seems to think it's ok to do that and not pay I'm sure he would be ok with the damage to his BMW as well!! Incidentally I would make sure there was at least 4 times the amount of damage to the car btu I would certainly be pushing to get some cash out of him first. Is there anyone in your wife's family who can apply some pressure to make him see sense before this escalates? I doubt whether the police would be interested though; is this not a civil rather than criminal matter? Perhaps one of our bobbies would know the answer to that. If no joy through other ways, try a solicitors letter followed by the small claims court (assuming same rules in Scotland). I know it's tempting to want to get your own back and damage something of his but that's how family feuds start and I doubt your wife would thank you for it. Staggering though that anyone thinks it's acceptable to cause £500 damage to someone's else's property and not pay for it. Even if it had been fully comp there's no reason why you should make a claim and lose your NCB, pay the excess, etc, anyway. |
My blood is boiling also TP............ The guy is loaded and i mean minted, he won the "National" at the bingo a few years ago about 100k...and he owns a taxi company. More money than sense!!! If i was home back on dry land i would be sinking a cold one, to try and calm down. |

It never ceases to amaze me the stupidity of people. You need something like a wheelclamp,which costs say....£500 to get removed.Failing that you could always borrow something for security,even if its from HIS wife-embarress the prat into paying up. Putting his name in the local papers would be funny,people love stories of how rich guys are so meanly petty. Theres more ways to get at people without resorting to their level,get everyone you know to phone up his taxi firm and book his cabs on goose chases for a few nights,once he starts to lose his own cash in front of others he might think twice about being cavalier with other peoples property. You might never get your money back,but I'm a great believer in getting even,especially when its the sort of subtle aggravation that they cant do anything about.:devil: |
:( Mmmm. This is not a police matter. The damage was accidental or thats what he would say. There is a part to the criminal damage legislation that states that if the person was reckless then that would be criminal but this does not count here. (For example, a person throws a brick and does not care where it ends up. The brick smashes a window that is not his, get it?) I suppose its a course of going through the civil court.:( Sorry mate. Is there a Scottish equivalent to the Small Claims Court? If so, that's you best bet (cheap, too). After the legalities are sorted, I foresee a nasty injury from slip involving the shower and a bar of soap - most accidents happen at home, you know! As for damaging his BMW - it's your civic obligation to do so, regardless of anything he's done. BMW drivers ... don't even get me started. |

This must be a nightmare for u. I think the man must be a complete ars8ehole to turn around and not offer to at least pay some thing for the damage he caused whether by accident or misadventure. Is it worth contacting your house policy to see if they would cover it. Putting pressure on your man may not bring any results unless you sit in one of his taxis with a Stanley knife and have another little accident with that and a leather seat, on doggy ground hear making suggestions I think. Reason may not be the key. We are all vunerable to the friendly family visits and the " can I sit on it" brigade, fine if you are standing next to it ,fatal if your'e not as you have found out. Although this is a fair few bob, its not life threatening or going to bankrupt you, and family are family what ever cards you are dealt. Calm down and try to see things in a friendlier light, being to agressive may not be the key.Im sure when the other family members get to now about it, thinks may change for the better . 4D |

Ok so far i have offers of help from 1 hard as nails Southerner with 4 mates and their pitbulls ;) Someone else pledging 5 litres of brake fluid and their kids super soaker (If i promise to return the soaker when i am finished) Me thinks i am off to JJB and the sports equipment section to buy one of those metal baseball bats, at least the i will get a nice "Dink" sound when it connects with his knees!!!! Reading the posts are funny it is like having a good and bad side sat on each shoulder............. Luckly i am not home until Tuesday so that will give me time to calm down. claim he backed into it in the beemer, get your wife to back you up and sue him for the damage thru his insurance company....failing that offer to 'clean' his car and take the Tera approach;) |

ScottyB, I know exactly how you feel. Some years back when I got my first Duke-900SS-I took it round to my ex-partners to show her and her boys since she had asked me to. I went in the house, boys went out to see the bike-I think you can guess the rest................ When I went back out there was her 11 year old trying to pick up a 900SS-which he swore 'just fell over'! Like you I had to walk away-I could have killed the little ****,-especially since he was the main reason we split up....... She was mortified and wanted to pay for the damage but I wouldn't let her. Bit different to your circumstances. I would be careful with the baseball bat, tempting though it may seem-but paint stripper and a knife in all 4 tyres should even things up a bit-especially if it gets done away from the house...........:devil: John |
Ok...Let's be calm and look at the situation... At the end of the day It is ONLY a bike...My hubby is always telling me that...'specially after the 3rd "drop"! ...the money isn't really the issue here, is it? What you are really angry about is the "lack of RESECT" this family member has shown to you. I nor my hubby (even with our differing opinions on bikes) would NEVER sit on someones bike without being asked and the person being present. If your wife can cope with the family backlash that this will cause go for it...sue the ass off the Stoopid TW4T! In true DJtera stylie...I would just nip round and just calmly say " no worries mate...Just watch your back!" It's the little things you do that count...like when his works e-mail account comes up on all porn mailing lists or perhaps that bag of chips and peas that keeps being thrown at the window... stab him Go to his house and have a one to one with him. Ask him to pay half towards the damage stating this is the least he can do. If no joy get a hammer, a good one and tell him you are going to smack him on the collar bone proper then take it to his house. **** him he's got to have it :mad: |
Scotty - calm down, forget the whole thing happenned, make up with the guy, get your bike fixed, even offer him a go on it, kiss your wife and put the whole thing behind you. These sort of people are not worth it, they enjoy the conflict, it just eats into your every waking hour. Forget it and walk away. THEN - a year from now when it's all forgotten and your 'mates' with him, you go to work - the guy never needs to know, absolutely do not ever tell your wife. He gets a puncture, some kid runs a key along his car, dog poo through his letterbox, sign him up for every junk mail you can imagine, don't call the cabs they're probably owner drivers and you'll hit them, just keep plugging away until you have got him back ten times over - he's picked the wrong guy to mess with. Once you're 10 times 'even', then that'll probably do, it'll be out your system and nobody knows it except you...it feels good let me tell you. Sorry Scotty Fordie is the voice of reason, but personally i'd suggest the DJ approach for starters, follwed by the longer term Wee Jonny B stealth version as the main course, and as a delightfull desert i think crm250's idea is superb. I just couldn't let the obnoxious tosser get away with what he's done. |

Just a thought, claim on his household insurance most policies have a sort of public liability clause built into them in which covers visitors to the home. Murray Mint |
