Do I have a case against the council????

Just returned from a cracking day out at Thruxton (what the hell was Emmett thinking?).

While putting the disc lock on tonight in the garage I noticed that my front Marchesini is well and truly knackered - it has a major dent in it!

On the journey down I had a bit of a moment on a fairly fast right hander. The bike bucked a bit but not too much to concern me.

I am going to drive down there tomorrow night to check it out as I am not 100% whether it was just the cats eye or a pot-hole. The road was the A338 just south of Burbage, a fast right hander after some nice sweepers - anyone know it??

Anyway, if it is a fault with the road do I have a case? Has anyone taken this further and if so, what was the result and how did you go about it?

If it turns out to be just the cats eye - anyone got a front 5 spoke Marchesini for a 748s for sale???

Any help appreciated - thanks!
Jacko.

Mood: st2......we can rebuild
don't know of this directly but i think there was an article in our local paper about some one taking council to court over a pot hole though i can't remember details

a few pictures of the offending hole and a letter from the wheel manufacturer saying that a pot hole could cause that sort of damage should get you some where with them.
good luck.

going back a few years my background was in cycle racing (the pedal powered sort)

I was ridind a team time trial up near Redditch when I hit a pot hole doing about 30mph. It dented the rim and fractured the carbon of my rear disc wheel.

I took a couple of pictures of the wheel and a picture of the hole and contacted the local council ( I seem to remember they referred it to the highways agency).

In short they sent me a claim form and subsequently shelled out for a brand new wheel (cost about £500) without any further query.

I say go for it but be clear and precise - lots of photos and keep to the facts

Good luck!

Cheers fellas!

I'm going down there tomorrow evening to play chicken with the traffic and get some photo's.

It may just have been a cat's eye which I guess means I haven't really got a case.

Further to my original post, it looks like it hasn't broken the bead on the tyre (it's still bang on the right pressure after cooling down and being dented about 15 hours ago). A mate of mine reckons it could be repaired. There are no cracks etc. just a dent.

If anyone knows any decent wheels fixers in the Wilts/Hants/Glos/Oxon areas please post up their details.

Cheers.
Jacko.

Wheel repair

If the wheel is magensium, I would strongly advise against repairing it. Ali can be repaired, however.

I seriously doubt a cats eye would cause such damage

Then again surely you would have seen a pothole?!

Very odd!

A guy on rsvr.net hit a cats eye doing over a grands worth of damage to his wheel/discs etc.....here's what he discovered when he took it up with the highways -

Claiming against the council for this one. As you can see (if the picture comes out), it appears that the catseye (known as studs) hasn't been put into the road correctly. Got myself some official documentation from the same county council regarding the regs on these things. I qoute:

" a depressable stud, shall not project above the surface more than 25 millimetres at its highest point, whether depressed or not."

DJ, I dunno what's strange about the fact that I didn't see the pothole (if there is one - gonna check that later) but that doesn't mean it wasn't there - they are not all huge craters!

And besides, whilst making "ahem" progress I've got better things to watch for than little holes in the road.

FELIX:

Cheers for that, I will have to try and find some repairers and see whether its do-able. Surely they wouldn't do it if it was dodgy?

Any help on decent wheel repairers would be appreciated guys!

Cheers
Jacko.

Isn't that all part of making progress safely?
