Another NIP question

Today my daughter received a NIP for Driving without due care for a recent incident when a horse-box moved into the outside lane to 'block' her moving in front of him before the outside lane merged with the inside one. She saw him moving into her lane so used the horn to warn him but as she drew alongside she saw him look in his mirror and swerve out towards her, the vehicles made contact and she thought it was her wing-mirror.

She filtered into the inside lane in front of the horse-box and when some distance in front saw him giving her the 'finger', feeling a little intimidated she didn't stop but on reaching work she realised the nearside of her car was quite badly damaged.

She 'phoned a local police station then visited Winchester and told the Duty officer what happened and produced her documents, it was duly logged and she was assured that no action would be taken in a case like this.

The accompanying request for confimation of driver stated:-

Not reporting an accident
Failing to stop
Driving without due care & attention

On receiving the NIP she tried unsuccessfully to contact the issuing officer (from another station)

Any comments from those 'in the know' other than calling the solicitor?

Was she given an incident reference number when she went in and reported it? Get a copy of this and a name of who she spoke to.

The NIP will of come from a traffic admin support unit for whichever force it was issued with, try to contact someome there and explain the facts with the incident ref number.

Not reporting accident - if it WAS logged at winchester, there'll be record;
Failing to stop - you don't have to if you feel it unsafe to do so. You just gotta report it, which hopefulyy can be evidenced;
Driving without due care - where's the evidence of that if her statement was unchallenged?

I would reply to the NIP with statement of fact and request the NIP be withdrawn.
