Unhappy ebay welcher?
I won a pair of s/hand leather bike gloves on ebay last week for a good price.
I sent the guy a cheque, as he didn't do paypal.
I got an email from him that my cheque had arrived and that when he went to wrap the gloves up to send, he noticed some of the stitching had come undone and that he had returned my cheque, as he didn't want neg feedback.

I still wanted them regardless. I wouldn't have negged him.
He didn't even give me a chance to decide if I still wanted them.

Can he just not send them, as I was willing to have them as-is?

Id say so.

I won a set of fairings for my 749 once, real cheap. After numerous attempts to make contact with the seller and get things rolling (he never bothered to make any contact at all), I complained to eBay, and they said they couldnt force the seller to complete the deal, and it was tough luck!

I guess its a question of whether he is a genuine diligent seller, in which case he should be willing to complete the transaction once you have assured him you're happy with the gloves "as is". Or, whether he just didn't like the price they sold at...have you tried diplomatically suggesting you're more likely to neg him for not providing the gloves? If he refuses to send them, I don't think there's anything you can do except neg him (in which case, he'll probably neg you back )

Sometimes its best just to walk away from an ebay deal that's turning bad (particularly as you haven't lost any money). If he's dodgy, he'll probably be more than ready to neg you spuriously if you give him a hard time.

Call me a foolish "glass half full" optomist but, I think the poor guy might have been actually trying to do the right thing and had not noticed the stitching when he first put the gloves to auction.

Just Email the seller and tell you'd have them regardless?

I had someone renege on a sale a few weeks back, which appeared to be because the price was too low.

It was explained to me at the time, that the seller is under no obligation to agree the sale, this idea that it is a binding contract etc. is not correct.

Just one of those ebay things..

Sounds like its one rule for the buyer, another for the seller.

Its a binding contract for the buyer if the seller wants to sell, otherwise its worth **** all! What a load of bollox.
