Call me a foolish "glass half full" optomist but, I think the poor guy might have been actually trying to do the right thing and had not noticed the stitching when he first put the gloves to auction.

Just Email the seller and tell you'd have them regardless?

I had someone renege on a sale a few weeks back, which appeared to be because the price was too low.

It was explained to me at the time, that the seller is under no obligation to agree the sale, this idea that it is a binding contract etc. is not correct.

Just one of those ebay things..

Sounds like its one rule for the buyer, another for the seller.

Its a binding contract for the buyer if the seller wants to sell, otherwise its worth **** all! What a load of bollox.

I emailed him to say that I would have them. But his fisrt notice to me, said that the cheque was already posted back to me. Which has arrived torn-up.

He looks like a ducati owner as his ebay name has 748998 on the end and has been buying Ducati stuff.

anyone know of someone who has succesfully persued a claim for a non-payer?? I dont think much can really be done if you buy or not...apart from neg feedback

I'm with Frank - I think the guy just didnt want to stitch you up

I just got an email from him, saying that he will take some money (nearly 50%) off the final price.

I have agreed to this It's just a shame that he jumped the gun and sent the original payment back without disscussion.

All's well, etc......

Does it ever stop?

Bought something else the other day which was in "as new condition"
Payed by paypal. I have got a message from him (different seller) saying that when he has gone to package it, he has noticed some marks on it. Which doesn't affect it's function.
Now call me daft but I thouht as new was what it says.
I have asked for a refund, let's see what happens.....

Funny how people don't notice these things when they are actually taking the photo's of their items.
