You could always do what we used to do in the Army when we were having problems with someone who was clearly being unreasonable.

Scruff him by the back of the neck, drag him around behind your building and belt the living sh*te out of him - explain to him that if this problem persists so will his.

In all seriousness though, you may very well be better off seeking proper legal advice. If it saves your job and saves you stress (which you will be passing on to your pregnant wife) at a time when you need to be thinking of your family then it's worth it.

I bet you all think I'm joking about the Army thing

thanks for the link chicken, that is really useful.

yeti i guess i really dont want to get to the stage where i could be dismissed, as referances can be important in my area of work.
but its helpful to understand that this makes the 50 mile clause less enforceable.

webbyc diving licence is essential criteria of post holder, but company (as PB suggests) might consider a driver if i fund it? problem is im not a millionaire/ so might not be able to afford that/ depends on time scale etc

jpmercer I would be glad to recieve number if you can reccommend the lawyer, Il probly need to run the contact of employemnt, & procedures by someone like that.

thanks all

IF your contract & terms of employment makes provision for termination of employment, should you become disqualifed from driving - the company may be able to dismiss you without even giving one warning (we sadly lost an employee over this, last year).

If there is no provision regarding this, it could still be construed as gross misconduct - and even abusing company property!

GROSS MISCONDUCT----OUCH

I guess they might go for that coz it means they dont have to pay notice, huh? so if iwas to return from the magistrates on a day that things dont go so well, and resign?? what then??

its not all about money but a couple of months pay would make some diferance in the real world

Bungi, this is why I strongly recco you see someone asap mate.

Sorry

We could all be making a mountain out of a molehill here (like the desmodue thread ) but I was trying to take an objective view from what you had presented - this is why you MUST see somebody, before reading any more gloom & doom into things.

Apologies,
C
