Angry Speeding Ticket
Just received a N.I.P from the police informing me I had beed done for 46 in a 30 zone.

I travel down that road every day and I know there is no speed camera there and it was also at 07:16 in the morning.

Does anyone have copy`s of the MCN articles about not disclosing personal details of the driver etc as in contravenes (I know its not spelt correct!) your rights to remain silent so as not to incriminate yourself.

I also beleive that if they do not give you their evidence withing the last 7 days on the 28 day required for you to submit your details, then the case is not admisible in court!

There was also a letter printed in MCD about admitting the offence and pleading guilty under threat, this also being inadmisable in court.

Some help would be appreciated chaps as they have told me they have photographic evidence but I do not have their evidence!

My understanding is that they have to serve notice on you within 14 days of the offence or it is time barred.

With regard to disclosing details of the driver, there is a test case going through the European Courts at this time, but will almost certainly not be resolved until after your case.

If you are likely to get done under the totting up system then you are advised to see a Solicitor who specialises in these types of offences.

The 14 days is for them to issue and post the NIP, it can take as long as it takes to get to the driver - hire vehicles/fleet cars etc. can come through much later and still be valid provided the NIP is issued within the 14 days.

Where was the offence commited . Was it somewhere local to ourselfs.
Ditto Pepipoo. I got some good advice off them some time ago.

Bad luck mate,
It would have been someone hiding in a van that got you,....the same as when I got done coming back from the GP.
I was pretty peed off about it too,and looked into the 'legal loopholes'.At the end of the day it was far easier to grin and bear it and pay the fine.£60 and 3 points.
